American Military Government in Germany. At this Military Government court in Beyreuth, Albert Ellwanger, Sr. (standing, seconf from Right), and his son, Albert Ellwanger, Jr. (right), are being tried for what amounted to "selling pretection"to civilians. The two printed "OFF LIMITS TO ALLIED TROOPS"signs and sold them to property owners for posting. At left is Sergeant Kurt Hufelder, an interpreter. Acting as judge is Captain William T. Robinson, Deputy Military Government Officer of Bayreuth, while Lieutenant Irving Moschel, Legal Officer, is prosecuting the case. A clerk stands between Lieutenant Moschel and the older defendant. The pair pleaded guilty and were sentenced to pay a heavy fine. These courts meet regularly to try offenders of Military Government regulations and have jurisdiction over offences against laws of the Military Government by persons within the occupied territory exept members of the Allied forces. Three grades of courts are operated: A General Military Court of not less than thre officers, an Intermediate Military Court of one or more officers and a Summary Military Court consisting of one officer. In each court, at least one member must be a lawyer serving with the Military Government. The natur of the offense determines the court in which it will be tried. There is no appellate jurisdiction but all cases are reviewed administratively. The accused may be represented by counsel or conduct his own defense.
